USFSPA Changes 2009, 2010, 2011 ... Changes in USFSPA Law Legislation

The Uniformed Services Former Spouses' Protection Act Changes - USFSPA continues to cause emotional reactions and this page is dedicated to links to those articles and organizations promoting USFSPA changes or generating a call to action for a USFSPA lawsuit.

No matter what your viewpoint on the current rules set by the Uniformed Services Former Spouses' Protection Act (USFSPA), one must realize that the USFSPA is intertwined with the rules surrounding the Survivor Benefit Plan (SBP) as well as the Continued Health Care Benefit Program (CHCBP) offered to the former military spouse. Thus a USFSPA change will require a change in these other programs as well.

CON - Against USFSPA Changes

In general, the article links provided below disagree with specific proposed changes in the USFSPA.

There are definitely logical examples of unfairness in the USFSPA. For example, a spouse married to a service member for 15 years will most likely receive a divided portion of the service member's retirement pay, yet an active duty service member with 15 years of service, who leaves the military, will receive nothing. The question is, how come a spouse who did not serve at all can receive something, yet the active duty member receives nothing?

While this is just one example, it easily shows the call for change. While some will focus on revamping the USFSPA, one should remember, there is the other choice of revamping the military retirement system so the active member could depart at 15 years with some sort of "retainer" pay.

The point here is only that one should read carefully on the emotional issue of USFSPA changes and clearly identify whether discussions are saying to NEVER change the USFSPA or only that they disagree with the current proposal for change.
